GST Appeal Enquiry Form

Enter your details below. The form will prepare an enquiry message for WhatsApp. You can then send your GST order copy separately.

PDF, JPG or PNG. Maximum 10 MB. For this version, selecting a file does not upload it. After opening WhatsApp or email, attach the order copy manually.

Submitting this enquiry does not itself constitute engagement, filing of a statutory appeal or an extension of any legal deadline. Please attach your order copy manually when contacting us. Avoid sharing passwords, OTPs or unnecessary sensitive information.

GST Appeal Procedure: Deadline, Payment & Filing

Received an adverse GST order? Three things matter immediately: your appeal deadline, the amount you must deposit, and the documents needed for filing. Our team helps you assess these requirements before proceeding.

Important: Under Section 107 of the CGST/KGST Act, a first appeal generally must be filed within three months from communication of the order. A further one-month delay may be condoned if sufficient cause is established.
01

Check Your Deadline

We examine the order and communication records to calculate the limitation period and identify any urgency before filing.

02

Calculate Your Pre-Deposit

We determine the admitted dues, disputed tax and applicable statutory pre-deposit before the appeal is submitted.

03

Prepare & File APL-01

We prepare the appeal grounds, organise supporting records and assist with online filing and acknowledgement follow-up.

How Much Must You Pay to File a GST Appeal?

For a typical first appeal against a tax demand, Section 107(6) generally requires payment of the admitted dues and a pre-deposit of 10% of the remaining disputed tax, subject to the applicable statutory conditions and limits.

Particulars Illustrative Amount
Disputed tax ₹20,00,000
Pre-deposit at 10% ₹2,00,000
Remaining disputed tax ₹18,00,000

This example assumes that the entire tax amount is disputed and no tax liability is admitted. The actual calculation depends on your order and applicable law.

Can recovery be stopped? Section 107(7) provides for a deemed stay of recovery of the balance amount once the payment required under Section 107(6) has been made. We verify the payment and filing requirements before advising on recovery-related protection.

What If the GST Portal Shows a Payment Error?

A mismatch involving DRC-03, the electronic liability records or pre-deposit payment can delay filing. We help reconcile payment records, identify the issue and document portal errors. A technical grievance does not automatically extend the statutory appeal deadline.

Not Sure How Much You Must Pay?

Send us your GST order and its communication date. We can assess the limitation period, applicable pre-deposit and next steps for your appeal.

GST Cancellation Appeal & Revocation

Has the GST department cancelled your registration? You may lose the ability to issue valid tax invoices, collect GST as a registered supplier and conduct normal business operations under an active registration. The correct remedy depends on who cancelled the registration, why it was cancelled and when the order was communicated.

Remedy 01

Appeal Against GST Cancellation

If the GST officer cancelled your registration and you believe the order is incorrect, you may be able to challenge it before the appropriate appellate authority.

  • Review the cancellation order and stated reasons.
  • Examine notices, replies and hearing records.
  • Prepare grounds supported by documents.
  • Check the appeal deadline and applicable requirements.
Remedy 02

Revocation of GST Registration Cancellation

Where the law permits, an application for revocation may help restore a registration cancelled by the department. Eligibility and compliance requirements must be checked first.

  • Identify the reason for cancellation.
  • Review pending returns and applicable tax dues.
  • Check the prescribed application period.
  • Prepare the application and supporting documents.
Appeal or revocation: which should you choose?

These are different legal remedies. Revocation generally concerns restoration of a registration cancelled by the proper officer, subject to the applicable statutory conditions. An appeal challenges an appealable order. The correct route depends on your facts and the law in force.

Documents We Need to Review Your Case

  • GST registration certificate and GSTIN.
  • Cancellation order and notice, if available.
  • Replies already submitted to the department.
  • Pending return and tax-payment details.
  • Supporting business records and departmental correspondence.

GSTAT Second Appeal & High Court Remedies

Has your first GST appeal been rejected, or has the appellate authority upheld a disputed demand? You may have further legal remedies. The appropriate forum depends on the order, the grounds of challenge, statutory deadlines and the applicable provisions.

Second Appeal

GST Appellate Tribunal (GSTAT)

Eligible taxpayers can challenge an order of the first appellate authority before the GST Appellate Tribunal. We review the earlier order, identify appealable errors and assist with the applicable filing requirements, pre-deposit and written submissions.

Constitutional Remedy

High Court GST Appeal

Where the law permits, a High Court petition or appeal may be considered for jurisdictional errors, violations of natural justice or other legally sustainable grounds. The appropriate remedy depends on the facts and statutory appeal structure.

Further Appeal

Supreme Court Proceedings

Further proceedings before the Supreme Court may be available in eligible cases, subject to the governing statutory provisions and constitutional jurisdiction. We help assess the appropriate procedural route and further legal requirements.

Important: An unfavourable GST order does not automatically mean that every higher court remedy is available. GSTAT appeals generally involve statutory filing and pre-deposit requirements. A High Court challenge must satisfy the applicable legal grounds and maintainability requirements. Supreme Court proceedings are subject to their own jurisdictional rules.

How We Help With Further GST Appeals

  • Review the first appellate order and earlier submissions.
  • Identify possible errors in law, jurisdiction or procedure.
  • Examine the applicable limitation period and pre-deposit.
  • Prepare appeal papers and supporting legal submissions.
  • Coordinate representation and further proceedings as agreed.

GST First Appeal Rejected? Explore Your Next Legal Remedy

Did your GST appeal fail before the Joint Commissioner (Appeals), Additional Commissioner (Appeals) or another designated first appellate authority?

An unfavourable first appeal order does not necessarily mean that your GST dispute is over. Depending on the order, applicable law and limitation period, a further appeal may be available before the Goods and Services Tax Appellate Tribunal (GSTAT).

At Prakasha and Co, Bengaluru, CA Damodharaa R can review the first appellate order, including cases previously handled by another consultant, and assess the available next steps.

How We Can Assist After an Unsuccessful GST Appeal

  • Independent review of the earlier appeal: Examine the order, grounds raised, evidence submitted and reasoning adopted by the appellate authority.
  • Identify potential appeal grounds: Assess whether the order raises arguable issues involving GST provisions, ITC eligibility, tax demand, limitation, natural justice, evidence or procedural compliance.
  • Review the earlier consultant’s work: Examine available filings and submissions to identify issues that may require further legal analysis. The review does not presume that the earlier consultant made an error.
  • Assess a second appeal before GSTAT: Where legally maintainable, evaluate the grounds, limitation, applicable pre-deposit and documentation required for the next appellate stage.
  • Prepare the next-stage appeal: Assist with organising the record, formulating grounds and preparing the appeal within the applicable legal framework.
Act promptly: A second appeal has its own limitation requirements. The applicable filing date, transitional provisions, forum and pre-deposit must be verified against your particular order. Do not assume that obtaining a review automatically extends the deadline.

GST DRC-03A: Adjustment of GST Payment Towards a Demand

Have you already paid an amount through Form GST DRC-03 but the payment is not reflected against the relevant demand? Form GST DRC-03A provides a mechanism, subject to applicable conditions, to link an eligible DRC-03 payment with the corresponding demand.

When Is Form GST DRC-03A Relevant?

  • A payment intended for a specific GST demand was made through Form GST DRC-03.
  • The payment needs to be mapped to the corresponding demand reference or Demand ID.
  • The eligible amount may need to be considered while determining the outstanding liability or applicable appeal pre-deposit.
  • The taxpayer needs to verify whether the payment and demand qualify for adjustment under the applicable rules and guidance.

How the DRC-03A Process Works

  1. Review the demand: Identify the relevant order, demand reference and outstanding liability.
  2. Verify the original payment: Check the DRC-03, payment date, amount, tax heads and supporting challan or receipt.
  3. Check eligibility: Confirm that the payment and proceedings qualify for adjustment through DRC-03A.
  4. Complete the applicable adjustment process: Submit the DRC-03A application through the GST portal where available and retain the acknowledgement and supporting records.
  5. Recheck the demand and appeal requirement: Verify the updated liability records and calculate any remaining amount payable, including the applicable appeal pre-deposit.
Important legal distinction: DRC-03A is not a separate GST appeal and does not itself challenge or set aside the demand order. It concerns adjustment of an eligible payment against a demand. Eligibility restrictions may apply, including where proceedings have already concluded in the circumstances specified under the rules. Confirm the current portal process before filing.

GST Appeal APL-01, DRC-03A & Second Appeal FAQs

1. What is the time limit to file GST Appeal Form APL-01?
Under Section 107 of the CGST Act, the general period is three months from communication of the order. The first appellate authority may condone a further period of up to one month if the statutory conditions are satisfied. Confirm the applicable deadline for your specific order.
2. What is Form GST DRC-03A?
Form GST DRC-03A provides a mechanism to adjust an eligible payment previously made through DRC-03 against the relevant demand. The payment can then be considered for the applicable liability or appeal pre-deposit in accordance with the rules and relevant guidance.
3. Is DRC-03A required if I already paid through DRC-03?
If a payment intended for a particular demand was made through DRC-03 and has not been mapped to that demand, DRC-03A may be relevant. First verify the payment details, demand reference, eligibility and current portal procedure. Certain completed proceedings may be excluded from this adjustment mechanism.
4. Can I appeal to the next level if my first GST appeal is rejected?
A further appeal may be available before GSTAT against an eligible first appellate order. The appropriate forum, limitation period, pre-deposit and maintainability must be checked against the particular order and applicable law.
5. Can Prakasha and Co review an appeal handled by another consultant?
Yes. You can request an independent review of the order, earlier grounds, submissions and available evidence. The review can assess potential legal issues and possible next steps without assuming that the earlier consultant’s work was necessarily incorrect.
6. What if the limitation period for my next appeal is approaching?
Arrange a prompt review of the order and its communication date. The applicable limitation period and any available statutory provisions must be assessed immediately. Do not assume that requesting a consultation, rectification or payment adjustment automatically extends the appeal deadline.
7. Is a 10% pre-deposit required for a GST appeal?
Section 107 generally requires payment of admitted dues and a prescribed pre-deposit linked to the remaining disputed tax, subject to statutory conditions and applicable limits. The requirement for a further appeal is governed by the provisions applicable to that stage. Calculate the amount from the order and verify the current law before filing.
8. Does filing an appeal automatically stop GST recovery?
Statutory recovery protection is subject to the applicable provisions and fulfilment of the prescribed conditions, including payment requirements where relevant. Retain the appeal acknowledgement and payment evidence, and verify the status of the demand rather than assuming that filing alone resolves every recovery issue.
9. Can I challenge a GST demand involving disallowed ITC?
Depending on the facts and applicable law, potential grounds may involve ITC eligibility, invoices, return data, reconciliations, supplier information, procedural compliance or the reasoning in the order. The strength of any appeal depends on the specific evidence and legal provisions for the relevant tax period.
10. Can I seek rectification instead of filing a further appeal?
Rectification may be available for an error apparent on the record where the statutory requirements are met. It is not a substitute for every appeal ground and should not be assumed to suspend or extend the limitation period for an appeal. Review the available remedies before deciding how to proceed.

GST Appeal FAQs: Demand Notices, APL-01 & Legal Remedies

Received a GST demand notice, facing a large tax demand or lost your first appeal? Find answers to common questions about GST appeals, documentation, professional fees and possible next steps.

1. Received a GST demand notice? What should I do first?
Do not ignore the notice. Share the notice, annexures, relevant returns and earlier replies with a GST professional. We review the issue, applicable response deadline and available options before recommending the next step.
2. My GST demand is very high. Can it be reduced or challenged?
Depending on the facts, the demand may be challenged on legally sustainable grounds involving tax calculation, ITC eligibility, reconciliation, interpretation of GST provisions, limitation or procedural issues. We examine the records and assess possible remedies. Any reduction or relief depends on the merits of the case and the decision of the competent authority.
3. My GST first appeal was rejected by the Joint Commissioner. Can you take up the next appeal?
Yes, you can approach us even if another consultant handled your earlier appeal. We review the first appellate order, previous grounds, submissions and supporting evidence. Where a further appeal is legally available, we assess the next steps, applicable limitation period, pre-deposit and filing requirements. Our team can assist with preparing the next appeal and related representation within the agreed scope.
4. Can you review a GST case handled by another CA or consultant?
Yes. We can independently review the GST order, earlier appeal papers and available evidence. This helps identify issues that may need further legal analysis and determine whether another remedy may be available. The review does not automatically mean that the previous consultant made an error.
5. What details and documents should I share for a GST appeal review?
To begin, please provide:
  • Your GSTIN and business name.
  • The GST notice, show-cause notice or impugned order.
  • The date you received or accessed the order.
  • Earlier replies, appeal papers and hearing communications.
  • Relevant GST returns, ITC records and reconciliations.
  • DRC-03 payment proof, DRC-03A details and pre-deposit records, if applicable.
We will identify any additional documents required after the initial review. Please do not share your GST portal password, OTP or authentication credentials. Documents can be shared securely through an agreed channel.
6. How much do GST appeal services cost?
Our indicative professional fee for preparing and filing a first GST appeal in Form APL-01 is ₹15,000–₹25,000. Representation is approximately ₹7,500–₹10,000 per hearing, subject to the agreed scope. A rejected first appeal, GSTAT matter or complex demand may require a separate quotation after reviewing the order. Statutory pre-deposit and other applicable expenses are additional.
7. How long does GST appeal filing take?
The preparation period depends on the completeness of documents, complexity of the dispute and urgency. After reviewing the records, we explain the expected preparation steps. The time taken by the appellate authority to schedule hearings and pass an order is outside our control.
8. A GST officer is pressuring me to pay a disputed demand. What should I do?
Request and preserve the relevant written notice, order, demand reference and payment instructions. Verify the legal basis and current status of the demand before deciding how to respond. Do not ignore formal communications or statutory deadlines. We can review the records and explain the available legal and procedural options. Any allegation of misconduct should be assessed separately on its evidence.
9. Can I use Form GST DRC-03A if I already paid through DRC-03?
DRC-03A may be relevant where an eligible DRC-03 payment needs to be adjusted against the corresponding demand. Eligibility and the applicable portal procedure must be checked. DRC-03A is a payment adjustment mechanism, not an appeal against the demand itself.
10. Can GST proceedings be challenged if I was not given a proper hearing?
Depending on the applicable provisions and facts, failure to provide a required opportunity of hearing may be a relevant procedural ground. We review the notice, replies, hearing records and order to assess whether the issue supports a legally available remedy.
11. Why choose Prakasha and Co for GST appeal assistance?
Prakasha and Co offers GST dispute review and appeal assistance led by CA Damodharaa R, with over 20 years of professional experience as advised by the firm. Our approach draws on GST specialists and legal support, including advocates where required, to assess statutory provisions, legal interpretation, evidence and available remedies. The engagement and representation scope will be explained before proceeding.
12. How long has your team been handling GST matters?
Our GST-related work spans the GST regime introduced in India in 2017. We focus on reviewing GST notices and orders, understanding the relevant provisions and interpreting the law in the context of each business’s records. The specific experience and role of each professional involved will depend on the matter.
Important: GST appeal deadlines, pre-deposit requirements and available remedies depend on the applicable law and the particular order. Early review is important, especially where a demand is substantial or an appeal deadline is approaching. No particular outcome or tax-demand reduction can be guaranteed.
